Please read these Terms & Conditions ("Terms") carefully before using the UpVoteIt mobile application ("App") operated by UpVoteIt ("we", "us", or "our"). By accessing or using the App you agree to be bound by these Terms. If you do not agree, please do not use the App.
1. Eligibility
You must be at least 13 years old to use the App. By using the App you represent that you meet this age requirement. If you are under the age of majority in your jurisdiction, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
2. Account
You sign in through your Google account. You are responsible for maintaining the security of your Google credentials and for all activity that occurs under your account. You must notify us immediately if you suspect unauthorized use.
3. User-Generated Content
The App allows you to create rankings, add items (with titles, descriptions, and images), and submit votes. You retain ownership of the content you upload but grant us a worldwide, royalty-free, non-exclusive license to host, display, and distribute that content within the App as necessary to provide the service.
4. Prohibited Content
You agree not to upload, publish, or share any content that:
- Contains nudity, sexually explicit material, or pornography.
- Is violent, graphic, or gory beyond what is appropriate for a general audience.
- Constitutes hate speech — content that promotes or incites hatred, discrimination, or violence against individuals or groups based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or any other protected characteristic.
- Is harassing, bullying, threatening, or intimidating toward any person.
- Contains or promotes illegal activity, including but not limited to drug use, terrorism, or human trafficking.
- Is defamatory, libelous, or fraudulent.
- Infringes any third party's intellectual property rights (copyright, trademark, etc.).
- Contains spam, malware, phishing links, or any form of deceptive content.
- Impersonates another person or entity, or misrepresents your affiliation.
- Is otherwise offensive, harmful, or inappropriate for a general audience.
5. Content Enforcement
We reserve the right to review, remove, or disable access to any content that violates these Terms, at our sole discretion and without prior notice. Repeated or severe violations may result in temporary suspension or permanent termination of your account.

6. Intellectual Property
The App, its original content (excluding user-generated content), features, and functionality are and will remain the exclusive property of UpVoteIt. The App is protected by copyright, trademark, and other applicable laws. Our trademarks may not be used without prior written consent.
7. Disclaimer of Warranties
The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
8. Limitation of Liability
To the maximum extent permitted by applicable law, UpVoteIt shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or profits, arising out of or related to your use of the App.
9. Third-Party Services
The App uses third-party services including Google Sign-In, Firebase, and others. Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the practices of any third-party service.
10. Termination
We may terminate or suspend your account and access to the App immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the App ceases immediately. You may also delete your account at any time via our Account Deletion page.
11. Changes to These Terms
We reserve the right to modify these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the App after changes constitutes acceptance of the revised Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.
